Additional Use Grant

You may use the Licensed Work in production for your own internal business purposes, including operating it for your own organization or personal use, at no cost.

You may NOT:

1. Use the Licensed Work to provide a hosted, managed, or cloud service to third parties, whether paid or free. This includes, but is not limited to, operating the Licensed Work as a software-as-a-service (SaaS), platform-as-a-service (PaaS), managed hosting, or any similar offering.
2. Use the Licensed Work to provide functionality, data processing, or access to unaffiliated third parties as part of a commercial offering — including consulting engagements, managed services, outsourced operations, or any arrangement where third parties interact with or benefit from the Licensed Work as part of a service you operate, regardless of how that service is described or marketed.
3. Offer the Licensed Work, or any derivative or modified version, as an embedded or bundled component of a product or platform sold or licensed to third parties.

Only remarQable LLC (or its expressly authorized partners under written agreement) may offer the Licensed Work as a hosted, managed, or third-party-facing service.

For clarity: installation and use of the Licensed Work by an organization for its own employees, contractors, and internal operations is permitted. An IT consultant or agency may install the Licensed Work on behalf of a client, provided the client is the operator and sole beneficiary of that installation.

Terms

The Licensor hereby grants you the right to copy, modify, create derivative works, redistribute, and make non-production use of the Licensed Work. The Licensor additionally makes the Additional Use Grant stated above, permitting production use subject to the restrictions described therein.

If your use of the Licensed Work does not comply with the requirements currently in effect as described in this License, you must purchase a commercial license from the Licensor, its affiliated entities, or authorized resellers, or you must refrain from using the Licensed Work.

All copies of the original and modified Licensed Work, and derivative works of the Licensed Work, are subject to this License. This License applies separately for each version of the Licensed Work and may vary for each version of the Licensed Work released by Licensor.

You must conspicuously display this License on each original or modified copy of the Licensed Work. If you receive the Licensed Work in original or modified form from a third party, the terms and conditions set forth in this License apply to your use of that work.

Any use of the Licensed Work in violation of this License will automatically terminate your rights under this License for the current and all other versions of the Licensed Work.

Trademarks

This License does not grant you any right in any trademark or logo of Licensor or its affiliates. Without limiting the foregoing:

1. You may not use the names "sparQ", "sparQOne", "remarQable", or any associated logos in any manner that implies endorsement by, affiliation with, or sponsorship by remarQable LLC.
2. You may not use "sparQ" or "sparQOne" in product names, service names, domain names, or marketing materials for any derivative work or competing offering.
3. If you redistribute the Licensed Work in unmodified form, you must retain all original trademark and copyright notices.
4. If you create a derivative work, you must clearly indicate that it is a modified version not endorsed by remarQable LLC, and you must not use sparQ trademarks in the name of the derivative work.

remarQable LLC may publish separate Trademark Usage Guidelines. In the event of conflict, those guidelines shall supplement this section.

Contributions

Any contribution (including but not limited to code, documentation, bug reports, suggestions, or other materials) submitted to the Licensed Work, whether via pull request, email, forum, or any other channel, is subject to the following terms:

1. You grant remarQable LLC a perpetual, worldwide, non-exclusive, royalty-free, irrevocable license to use, reproduce, modify, distribute, sublicense, and otherwise exploit your contribution in any form and for any purpose, including incorporation into the Licensed Work or any commercial product or service.
2. You represent that you have the legal right to grant this license and that your contribution does not infringe any third-party rights.
3. You understand that your contribution may be used in proprietary and commercial offerings by remarQable LLC without further compensation or attribution, unless separately agreed in writing.

remarQable LLC may additionally require execution of a formal Contributor License Agreement (CLA) before accepting contributions.

To the extent permitted by applicable law, the Licensed Work is provided on an "as is" basis. Licensor hereby disclaims all warranties and conditions, express or implied, including (without limitation) warranties of merchantability, fitness for a particular purpose, non-infringement, and title.
